Fees & Policies
Hourly Rate for Mediation and Arbitration
Two parties: $200 per hour for each party.
Three parties: $150 per hour for each party.
Four parties: $125 per hour for each party.
Five or more parties: $600 per hour divided equally among all parties.
Multiple individuals or entities that share common interests and are represented by one attorney or one law firm will be treated as one party.
Hourly rate includes all time working on the matter including preparation, document review, time spent in conference, drafting settlement memorandum, drafting mediator/arbitrator report, drafting arbitration decision, and electronic filing and service.
The hourly rate does not include expenses for conference room rentals.
By selecting Mr. Brazzeal to conduct a non-binding arbitration, the parties agree to waive the per diem limitation on non-binding arbitration fees in Florida Statute Section 44.103(3) regardless of whether the matter is referred to non-binding arbitration by the Court.
Minimum Charge
There will be a 3 hour minimum charge for half-day mediations and arbitrations.
There will be a 6 hour minimum charge for full-day mediations and arbitrations.

Cancellation Policy
$600 fee for half-day mediations and arbitrations canceled within 7 days of the scheduled date.
$1,200 fee for full-day mediations and arbitrations canceled within 7 days of the scheduled date.
Cancellation fees will be divided equally among the parties and will be billed to their attorney or law firm unless otherwise agreed by the parties.
Billing and Payment
I do not require pre-payment.
After my involvement in this matter has concluded, I will email an invoice to the attorneys or law firms representing the parties. An invoice will not be sent to the parties or their insurance company unless otherwise agreed.
Payment is due within 30 days of receipt of invoice.

Scheduling
Half-day mediations and arbitrations are generally scheduled for 9:00 a.m. to 12:30 p.m. and 1:30 p.m. to 5:00 p.m.
Full-day mediations and arbitrations are generally scheduled for 9:00 a.m. to 4:30 p.m.
Mr. Brazzeal will attempt to accommodate reasonable scheduling requests.
Location
Mediations and arbitrations will be held virtually (Zoom), at a court reporter’s office, the office of an attorney representing a party, or another location agreed to by the parties.
Mr. Brazzeal will coordinate all virtual (Zoom) meetings.
The parties are responsible for coordinating any in-person mediation location and paying for any conference room rental fees. Mr. Brazzeal will assist the parties in coordinating a location upon request.
Travel Time
There will be no charge for travel for mediations and arbitrations held only virtually (Zoom).
There will be no charge for travel for mediations and arbitrations in the following counties: Lee, Collier, Charlotte, Sarasota, Hendry, and Broward. Travel outside of those counties will be charged at $100 per hour.
Confirmation
An Engagement Letter confirming the date, time, location, and hourly rate will be sent to the attorneys representing the parties.
An email will be sent with sign-in information for virtual mediations and arbitrations.
